Judge Denies Memphis Schools Lawsuit

MEMPHIS, Tenn. – A federal judge has decided not to grant a full trial in a Memphis school merger lawsuit, but has agreed to a request by a city council attorney to force the state to produce a witness for a deposition in the case.

Judge Samuel Mays Jr. declined Tuesday to grant a request by lawyers with the city of Memphis and Shelby County Commission for a trial in the lawsuit over Memphis City Schools’ attempt to merge with the county school system. Mays stuck with a previous order saying that he will rule from the bench in the lawsuit.

However, The Commercial Appeal reports that Mays did rule that the state must produce a witness for deposition over the narrow issue of whether Memphis City Schools is a special school district.
